Postmilo helps you prepare useful content. You choose what to use, review it before publishing, and remain responsible for the claims you make and the way you use the content.
1. Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Postmilo (“Postmilo,” “we,” “us,” or “our”). By creating or reconnecting an account, accessing the Service, or otherwise indicating your acceptance, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
“Service” means Postmilo’s websites, Messenger experiences, content recommendations, posts, articles, images, profile tools, and related features. If you purchase membership, the Membership Terms also apply.
2. Eligibility and authority
You must be at least 18 years old and legally able to enter into a contract to use the Service. If you use Postmilo for a business, organization, or professional practice, you represent that you have authority to bind that business or organization, and “you” includes it.
The Service is intended for lawful business and professional use in the United States. You are responsible for complying with the laws, professional rules, brand policies, and platform requirements that apply to you.
3. What Postmilo provides
Postmilo helps health and wellness professionals discover, prepare, personalize, and share posts, articles, and images. We may recommend content based on the brands and topics you select and may let you attach your public profile or contact details to content you share.
Postmilo does not post on your behalf. You decide what to use, what to edit, and where to publish it. We may add, remove, or change features as the Service develops. Paid access remains subject to the Membership Terms and the offer you purchased.
4. Your account and Messenger
Postmilo may use Meta Messenger to create, reconnect, and communicate with your Postmilo account. Your Postmilo identity may be associated with the Page-scoped identifier and other account information Meta makes available to us when you interact with the Postmilo Messenger account.
You must provide accurate information, keep access to your account secure, and promptly tell us at support@postmilo.com if you believe your account has been accessed without permission. You may not sell, transfer, share, or create accounts to avoid Service limits.
5. Your content
“User Content” means information and materials you submit to the Service, including profile information, text, images, links, brand and topic selections, edits, and support communications. As between you and Postmilo, you retain your rights in your User Content.
You grant Postmilo a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and process your User Content only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and enforce these Terms. This license ends when the content is deleted from our active systems, except for limited backup, legal, security, and already-shared copies.
You represent that you have the rights and permissions needed to submit and use your User Content. Do not submit patient records, protected health information, or other sensitive health information to Postmilo.
6. Postmilo content and commercial use
Subject to these Terms and any notice shown with particular content, Postmilo grants you a limited, non-exclusive, non-transferable license to edit and use posts, articles, and images made available to you through the Service for your own lawful business, professional, and marketing activities.
You may not sell or license Postmilo content as a standalone content library, distribute it in bulk, remove ownership notices, claim exclusive ownership, or use it to train or build a competing content service. Content is not exclusive, and the same or similar content may be available to other users.
Some content may include third-party names, trademarks, source material, or licensed assets. Those rights remain with their owners, and your use may be subject to additional notices or restrictions. Postmilo does not grant rights it does not have.
7. Health content and advertising responsibility
Postmilo provides content preparation tools and general informational content. It is not medical, legal, or regulatory advice, does not diagnose or treat any condition, and is not a substitute for advice from a qualified professional.
You are responsible for reviewing every post, article, image, and suggested statement before using or publishing it. Any claims about your products or services must be truthful, not misleading, and supported by the level of evidence required by law. You are also responsible for disclosures about compensation, employment, free products, affiliate relationships, brand relationships, testimonials, and endorsements.
Do not use the Service for emergency medical guidance, individualized treatment recommendations, unsubstantiated disease claims, or content that could reasonably cause physical harm.
8. Third-party services
The Service may connect with Meta Messenger, social networks, payment processors, hosting providers, and other third-party services. Those services are operated independently and governed by their own terms and privacy policies. We do not control their availability, security, policies, or decisions.
If Meta changes or restricts Messenger, if your Meta access changes, or if another connected service is unavailable, some Postmilo functions may be interrupted or unavailable. Postmilo is not affiliated with or endorsed by Meta or by any brand mentioned in user-selected content unless we expressly say otherwise.
9. Acceptable use
You may not use the Service to:
- break the law or promote fraud, deception, discrimination, harassment, violence, or illegal products or services;
- make false, misleading, or unsubstantiated health, earnings, product, or testimonial claims;
- infringe intellectual property, privacy, publicity, or other rights;
- send spam, unauthorized solicitations, phishing messages, malware, or harmful code;
- scrape, crawl, reverse engineer, interfere with, overload, or bypass access, security, or usage limits of the Service;
- resell access, impersonate another person, or use another person’s account without permission; or
- upload protected health information, payment card details, government identifiers, or other sensitive information not requested by the Service.
We may review, restrict, remove, or preserve content when reasonably necessary to operate the Service, investigate misuse, protect people or systems, or comply with law.
10. Membership and payment
Postmilo may offer free and paid features. Paid access is governed by the Membership Terms and the price, billing period, renewal status, taxes, and benefits displayed when you confirm a purchase.
You are responsible for charges you authorize and for keeping your payment information current. Unless required by law, a payment dispute does not remove amounts properly due under an accepted purchase.
11. Suspension, termination, and account closure
You may stop using the Service at any time and may request account deletion through the available account controls or by contacting support. We may suspend or terminate access if you materially or repeatedly violate these Terms, create legal or security risk, fail to pay amounts due, or misuse the Service.
We may give notice and an opportunity to correct an issue when practical. We may act immediately when needed to protect users, third parties, Postmilo, or the integrity of the Service. Account closure does not remove content that you already published to a third-party service or that another person lawfully retained.
Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, indemnification, and dispute terms—will survive.
12. Disclaimers
To the fullest extent permitted by law, the Service and all content are provided “as is” and “as available.” Postmilo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and results.
We do not guarantee that content will be accurate, complete, unique, compliant for your particular business, continuously available, or effective in producing engagement, customers, revenue, or any other outcome. Nothing in these Terms limits rights or warranties that cannot lawfully be excluded.
13. Limitation of liability and indemnification
To the fullest extent permitted by law, Postmilo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, business opportunities, or content, arising from or related to the Service.
Postmilo’s total liability for all claims arising from or related to the Service will not exceed the greater of the amount you paid Postmilo during the 12 months before the event giving rise to the claim or US $100. These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.
To the extent permitted by law, you will defend, indemnify, and hold Postmilo and its personnel harmless from third-party claims, losses, fines, and reasonable costs arising from your User Content, your published claims, your products or services, your violation of law, or your breach of these Terms.
14. Disputes
Before filing a formal claim, please contact support@postmilo.com so we can try to resolve the issue.
These Terms do not limit any rights that cannot be waived under applicable law. Any unresolved dispute may be brought before a court that has jurisdiction under applicable law.
15. Changes, general terms, and contact
We may update these Terms as the Service or law changes. The updated Terms will show a new effective date. If applicable law requires notice or acceptance for a change, we will provide it.
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining Terms will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the Membership Terms when applicable, and any purchase terms shown at checkout form the entire agreement for the Service.
